Since the issuance of the Guiding Opinions of the Ministry of Industry and Information Technology of the General Administration of Market Supervision on Promoting the construction of National Quality Standards Laboratories (State Regulatory Quality Development (2022) No. 21), it has received extensive attention from the industry. In order to accelerate the cultivation and creation of national quality standards laboratories, the General Administration of Market Supervision and the Ministry of Industry and Information Technology jointly formulated the "Management Measures for National Quality Standards Laboratories". It is hereby issued to you, and please implement it in accordance with actual conditions.

Measures for the administration of national quality standard laboratories

Chapter I General rules

Article 1 These Measures are formulated in order to enhance the competitiveness of industrial quality, support the construction of a strong quality country and a strong manufacturing country, and strengthen the construction and operation management of the national quality standards Laboratory in accordance with the Outline for the construction of a strong quality Country issued by the Central Committee of the Communist Party of China and The State Council.

Article 2 The National quality Standards Laboratory is a public welfare technology innovation platform for organizing basic and applied research on major quality standards, carrying out high-level quality standards formulation and application promotion, and gathering and training outstanding quality standards talents. The construction of the national quality standard laboratory is the key task of the quality infrastructure upgrading and efficiency project in the construction of a quality power.

Article 3 The National quality standards laboratory shall focus on all aspects affecting quality such as product design, production control, testing and management system, carry out scientific research and organize the research, formulation and promotion of corresponding standards. It mainly includes: undertake basic science and application research of quality standard; Strengthen key, forward-looking, strategic quality common technology research; Develop advanced quality standards, inspection and testing methods, high-end measurement standards, inspection and testing instruments, equipment and facilities; Solve the important problems of quality innovation, safety risk control and quality governance; Training quality standard leaders; We will accelerate the transformation of scientific research results and provide basic guarantee services for the high-quality development of industries.

Article 4 The National Quality Standards Laboratory, in the face of the urgent demand for quality innovation in major national strategic tasks, key projects and livelihood projects, in the core basic components, core basic components, key basic software, key basic materials, advanced basic processes, industrial technology and other industrial basic fields, In key areas such as high-end manufacturing, new materials, information technology, and biomedicine, efforts will be made to solve the bottleneck problems related to quality standards that restrict and affect the high-quality development of industries.

Article 5 The National quality standard laboratory is a scientific research entity built by scientific research institutes, institutions of higher learning and enterprises with strong research and development and technical radiation capabilities, and implements a relatively independent management mechanism of personnel and property. Encourage the adoption of industry-university-research and application-oriented cooperation models, and establish cross-industry and cross-regional consortia.

Article 6 The construction of the national quality standards laboratory shall adhere to scientific planning, reasonable layout, overall arrangement, step-by-step implementation, adhere to the best support, and implement dynamic adjustment.

Chapter II Management

Article 7 The General Administration of Market Regulation and the Ministry of Industry and Information Technology shall be responsible for the construction planning, establishment and cultivation, review and management of the National quality standards Laboratory. The main responsibilities are as follows:

(1) Formulate and implement national quality standard laboratory development guidelines and guiding policies, and make overall plans for laboratory layout.

(2) To guide the establishment and cultivation of national quality standard laboratories, and formulate conditions and specifications for laboratory construction, operation and service.

(3) Responsible for the construction review, operation evaluation and management of the national quality standards laboratory.

(4) Support the National quality standards Laboratory to carry out quality standards research and the promotion and application of public welfare scientific research results.

Article 8 The State Administration for Market Regulation and the Ministry of Industry and Information Technology jointly set up a coordination mechanism for the promotion of the National quality standards laboratory, responsible for the daily work of laboratory construction and operation management.

Article 9 The State Administration of Market Regulation and the Ministry of Industry and Information Technology jointly establish the Expert Technical Committee of the National Quality Standard Laboratory (hereinafter referred to as the Expert Committee). The responsibilities of the expert committee are: to formulate the development of laboratory construction and key task directions, review the technical requirements of laboratory construction, and carry out the national quality standards laboratory review. The Expert Committee consists of a chairman, 3-5 deputy chairmen and a number of members, the number of not less than 15 people. The term of office of the Expert Committee is two years.

Article 10 Central scientific research institutes, institutions of higher learning and enterprises directly under the central government shall apply for national quality standards laboratories, and the competent departments shall be responsible for recommending them. Local scientific research institutes, colleges and universities and local enterprises to declare the national quality standards laboratory by the provincial market supervision department, provincial industry and information technology departments jointly recommended. The main responsibilities of the recommending unit include:

(1) Implement the deployment of national quality standards laboratory construction, study and formulate policies and measures to support laboratory construction, and promote the inclusion of laboratory construction in the development plan of the department and the region.

(2) Check the scientificity, systematicness, completeness, authenticity, accuracy and legality of laboratory declaration materials.

(3) Assist in laboratory review, acceptance and evaluation.

Article 11 The application, construction and operation guarantee of the national quality standard laboratory shall be the responsibility of the supporting unit or the consortium. The main responsibilities of the supporting unit or consortium include:

(1) Formulate a national quality standard laboratory construction plan, clarify the laboratory research direction and functional positioning, construction objectives and other content.

(2) Support the construction and development of national quality standards laboratories, and provide necessary guarantees in terms of personnel strength, resource allocation, operation mechanism, scientific research sites, equipment and logistics services.

(3) Establish a management system for personnel, projects, equipment and funds that is compatible with the construction of the national quality standard laboratory.

(4) Establish and improve the personnel training and introduction mechanism of the unit and the construction of the national quality standard laboratory, and set up a research team with reasonable knowledge and age structure and relatively fixed backbone personnel.

(5) Recommend the director of the national quality standards laboratory and the director of the academic committee, and appoint laboratory personnel and members of the academic committee.

(6) Assist the daily management of the National quality Standards Laboratory, and cooperate with the review, acceptance and evaluation.

Chapter III Articles

Article 12 Laboratories applying for national quality standards must meet the following conditions, and provincial and ministerial laboratories that have been in operation for more than two years are preferentially recommended in principle.

(1) Facilities and conditions. It has good scientific research and experiment conditions, and has perfect supporting facilities and security guarantee capabilities. The existing research rooms are relatively concentrated, with an area of more than 3,000 square meters in principle, and the present value of instruments and equipment is more than 50 million yuan to meet the needs of scientific research. The measuring accuracy of the existing instruments and equipment has reached the domestic advanced level, the experimental data is accurate and reliable, and the measuring ability can meet the development needs of the laboratory. With strong data analysis ability, the data available for analysis can reach a certain storage scale.

(2) Academic team. The academic committee composed of experts with high academic attains in related fields is capable of playing an important academic guiding role in promoting the development of the laboratory, grasping the objectives, tasks and research directions of the laboratory, formulating and approving the medium and long-term plans of the laboratory, and reviewing major academic activities and annual work of the laboratory.

The research team of the laboratory has high-level academic leaders in the field, has an international vision, and holds technical positions in domestic or international organizations in the quality foundation and related fields, and has strong organizational management and coordination capabilities to ensure the working hours in the laboratory. The backbone of the research team is relatively fixed, the team has a reasonable age and knowledge structure, and has the ability to undertake major scientific research projects at the national and provincial levels and carry out extensive international and domestic academic exchanges and cooperation. The talent introduction mechanism is sound, which can attract and gather outstanding talents at home and abroad and cultivate reserve force of quality standards.

(3) Research ability. It has the research and practice foundation in related fields, with a strong research atmosphere and a good academic environment. In line with national quality standards laboratory construction layout and research focus requirements.

1. In recent 5 years, we have undertaken no less than 15 national scientific research projects in related fields or the total amount of the projects has reached 20 million yuan.

2. It is authoritative in grasping the development status, problems, technical keys and major needs of quality standards in this field.

3. Carry out and achieve international cutting-edge quality standards, measurement and testing technology breakthroughs, and solve the bottleneck problem of "stuck neck" common quality standards.

(4) Scientific research achievements. It has certain research achievements and applications in the fields of advanced quality standards, inspection and testing methods, high-end measuring instruments, development and verification of inspection and testing equipment and facilities, basic science and application research of quality standards, common quality technologies, and important problems in quality. With rich experience in industry-university-research cooperation, we actively provide public welfare quality service activities to the society. Any three of the following requirements must be met:

1. To achieve systematic and original results with international influence in the frontier exploration and research of quality standard technology.

2. Have innovative ideas and methods in solving the major problems facing the national quality development, and realize the innovation of relevant important basic principles, key technological breakthroughs or integration.

3. Have international leading technical achievements in related fields (new technology, new equipment, standards, regulations, norms, etc.), or the number of inspection methods issued by national standards, industry standards and departmental announcements in the past 3 years.

4. In the past three years, more than 15 scientific and technological achievements have been transformed, or the amount of quality and technical services provided in the field is not less than 30 million yuan.

5. Abundant quality standard data has been accumulated, which can provide support for research in related fields and provide scientific basis for national macro decision-making.

(5) Safeguard measures. The direction of laboratory construction is one of the key development directions of supporting units. Supporting units and recommending units can give priority to supporting the construction and development of national quality standards laboratories in terms of institutions, personnel, funds, resources, etc.

Chapter IV Application

Article 13 The national quality standard laboratory declaration is based on the principle of voluntarily, and the applicant shall submit an application to the recommended unit. The recommended unit shall conduct preliminary review and submit relevant materials as required. The General Administration of Market Supervision and the Ministry of Industry and Information Technology organize the form review, expert review, and site inspection, and determine the list of approved construction after publicity to the public. The specific implementation rules shall be formulated separately by the General Administration of Market Regulation and the Ministry of Industry and Information Technology.

Chapter V Construction

Article 14 The director responsibility system shall be implemented in the laboratory. The director of the laboratory is held by the senior leader of the supporting unit, which is politically reliable and has autonomy in the organization and implementation of scientific research tasks, the allocation of funds and conditions, and the employment of staff.

Article 15 The chairman of the academic committee is generally held by the staff of the non-supporting unit. The director of the academic committee should be a well-known expert with high influence in the field, with forward-looking and strategic vision, and have the ability to organize and coordinate the technical committee to guide the laboratory to carry out various research and application work smoothly.

Article 16 The laboratory shall attach importance to and strengthen operation management, and establish and improve internal rules and regulations. Research units should be set up according to key research tasks, and the structure and scale of the research team should be reasonable, and the flow should be appropriate.

Article 17 The National quality standards Laboratory shall complete various tasks such as principle innovation, quality technology research and development, standard research and development, tool development, personnel training and quality standards technical services in accordance with the construction objectives during the construction period with high quality.

Article 18 The construction period of the national quality standards laboratory is generally not more than 2 years. During the construction period, the laboratory will report the construction and operation of the laboratory every year and copy the supporting units. After the completion of the 2-year construction period, the laboratory submitted an application for acceptance. If the construction cannot be completed on time, an application for extension of the construction period shall be submitted three months before the scheduled completion of the construction period, and the reasons shall be explained. The extension period is up to 1 year. If the construction task cannot be completed after the delay, the construction of the laboratory shall be terminated.

Article 19 The expert committee shall make a comprehensive review based on the declaration and acceptance materials. The conclusion of acceptance is divided into three kinds: pass acceptance, rectification and fail acceptance. If the acceptance is passed, it shall be reviewed by the General Administration of Market Supervision and the Ministry of Industry and Information Technology and publicized to the public. If there is no objection, the laboratory will be officially opened. The rectification laboratory shall complete the rectification work within 6 months, and submit an application for acceptance again. If the laboratory fails to pass the acceptance after rectification, the construction of the laboratory shall be terminated.

Chapter VI Transportation

Article 20 The formal operation of the laboratory shall continue to carry out in-depth research, and the research results shall play a major role in improving the level of quality standards in the field and international influence, promoting the development of quality standards in the industrial chain, and solving the problems of quality standards, so as to produce major original results and lead the forefront of international science and technology.

Article 21 Laboratories shall carry out extensive exchanges and cooperation to promote open sharing. By setting up open topics, organizing international and domestic academic exchanges, and setting up post-doctoral workstations, we cultivate young talents in the field of quality standards, and attract high-level researchers at home and abroad to carry out cooperative research on quality standards in this field.

Article 22 Laboratories shall play a leading and radiating role, carry out public welfare quality assistance activities, actively provide quality standard services to the society, and improve social value.

Article 23 The monographs, papers, software, databases and other research results completed in the laboratory shall be marked with the name of the laboratory, patent applications, transfer of technological achievements, and application for awards shall be handled in accordance with the relevant provisions of the State.

24th laboratory name change, change of research direction or structural adjustment, reorganization and other major matters, by the laboratory to submit a written report, according to the circumstances of the laboratory review.

25th laboratory to provide false materials and untrue data, major academic integrity issues, or there are other violations of relevant laws and regulations and these measures, resulting in adverse effects, no longer included in the national quality standards laboratory sequence.

Chapter VII Evaluation

Article 26 The formally operating laboratory shall submit an annual operation report every year, and conduct a comprehensive evaluation every three years. The evaluation includes research level and ability, team building and personnel training, open communication and operation management, quality standard contribution and public welfare promotion.

Article 27 The comprehensive evaluation results are divided into three categories: excellent, qualified and unqualified. The laboratory whose comprehensive evaluation result is "unqualified" shall be notified and given half a year to rectify, and those who are still unqualified after the comprehensive evaluation of the rectification shall no longer be included in the national quality standard laboratory sequence.

Article 28 The General Administration of Market Regulation and the Ministry of Industry and Information Technology shall, in accordance with relevant plans and policies, arrange certain assistance and support for the national quality standard laboratories that are officially operating and whose comprehensive evaluation results are "excellent", support the qualified national quality standard laboratories to declare the corresponding national science and technology innovation bases, and increase publicity efforts.

Article 29 The State Administration for Market Regulation supports the officially operating national quality standards laboratory to carry out quality standards award application selection and pilot demonstration, supports the lead in carrying out international standards and national standards system revision, supports the application to undertake the work of the international standards Secretariat and the National Standards Technical Committee, supports the declaration of quality standards field projects, and encourages the laboratory to lead quality standards innovation.

Article 30 The Ministry of Industry and Information Technology supports the official operation of the national quality standards laboratory to participate in industrial basic reengineering projects, major technical equipment research projects, support participation in the construction of manufacturing innovation centers and industrial technology basic public service platforms, support participation in key core technology research, support to lead the preparation of industrial and information industry standards. Support the application of quality standard projects in the field of industry and information technology, and give preference to undertaking relevant projects and national science and technology plan projects.
